ABOUT THE JOB

Mission:
To provide legal advice to the entities of PF Spain (Banco Cetelem; GCC Consumo and the support AEIGs thereof), under the Legal department, across all areas and entities of the department’s responsibilities, including contracts, regulatory compliance, entities’ projects, and a high level of expertise in data protection. The role ensures the legal integrity of the Group’s activities and supports informed business decisions throughout the organization.

Main Legal functions and Responsibilities:
The Legal Department requires a multidisciplinary approach from its members, who will participate in all matters submitted to the department and in requests from BNP Paribas Group, including collaborative platforms:

  • Participate in reviewing, amending, and drafting contracts across the entities’ activities and business lines, ensuring compliance with applicable regulations and alignment with business strategy for financing and liability products whether for consumers or legal entities. 
  • Analyze, customer contracts and clauses for compliance with transparency regulations and banking best practices, proposing necessary actions to the relevant business areas.  
  • Provide legal analysis of requests for supervisory actions or inspections carried out by the Bank of Spain, when required.
  • Review, amend or draft electronic contracting processes, including electronic signature, authentication, cybersecurity and intellectual property matters.
  • Provide legal support on multiple projects across the entities, including product design and validation processes. 
  • Provide legal guidance to the different departments of the entities on any legal questions to ensure compliance with the applicable legal framework.
  • Analyze legislative developments and propose appropriate actions for the Group.
  • Provide legal expertise to the group-level regulatory platform and collaborate with the Group legal teams to review regulations and share best practices.

Specific Function:

Beyond the main legal functions outlined above, this role is responsible for:

  • Providing advice on Data Privacy / Data Protection matters, including:
    • Leading actions relating to proceedings or measures undertaken by the Spanish Data Protection Authority.
    • Providing legal advice on matters relating to security breaches.
    • Participation, as a member, in the BNPP PF Group Digital & IP Platform.
    • Reviewing processes, contractual documents and consultations to ensure compliance with data protection regulations across the projects and activities.
  • Collaborating with other team members in the review, amendment and drafting contractual documentation relating to the various activities and business lines, ensuring compliance with applicable regulations, for both financing and liability products, whether involving consumers or legal entities.   
  • Participation in legal assessment in the entities’ projects, contributing to a guidance legal throughout the project lifecycle.
